On 10th October, 2022, the complainant himself had agreed in front of counsel for the OP that he would clear the remaining amount of Rs.3 lakhs as per the award of Permanent Lok dalat(Electricity) in order to get his electricity restored. But today, the complainant is resiling from his earlier statement made before the Bench. On a pointed query raised by the Bench whether the amount of Rs.3,00,000/- which he had allegedly paid to the OP by way of five PDCs of Rs.60,000/- has been debited from his account or not, the reply of the complainant was that he had already given the PDCs for that amount to the OP and it was their responsibility to get them encashed meaning thereby that the said amount is still being enjoyed by the complainant. The complainant continued to maintain his stand that he gave the five PDCs of Rs.60,000/- each to OP but the OP on the last date of hearing denied having received/encashed. Admittedly the complainant owes the OP Rs.3,00,000/- as per the decision of the Lok Adalat. During arguments, the complainant challenged the order of Permanent Lok Adalat as according to him, the award was passed in his absence but at the same time he admitted that in compliance of the order of the Permanent Lok Adalat, he has already paid a sum of Rs.1,15,000/- to OP which the OP also admitted to have received vide their letter dated 26.09.2022 sent to complainant. In order to get the electricity re-energised at his residence, the complainant will have to clear the dues of OP amounting to Rs.3 lakhs.
We do not find any ground to interfere with our earlier order dated 10.10.2022 and accordingly dismiss the review application filed by the complainant.
