Present complainant in person and AR for OP. Complainant is facing financial problem hence filed an application to make the payment of entire amount of the impugned bill if allowed to make the payment in installments& also prayed for an interim order.
Copy of the application given to the OP. OP orally submits that the complainant is a habitual defaulter and has never made the payments regularly, therefore, the complainant be directed to deposit the entire amount on or before due date. OP filed statement of account dated 01.02.2018 in respect of C.A. No. 60006449064.
Heard both the parties and perused case file. In view of the submissions made by complainant & OP and particularly complainant’s bonafide willingness to make the payment in installments, it is hereby directed that complainant shall make payment of the bill no-10078704457 dated 30.01.2018 amounting to Rs.99,339/- in fourequal EMIs pertaining to above CA no.First installment shall be paid within 15 days from today and remaining threeinstallments shall be paid on or before 4thJuly, 4th August & 4th September-2018.Any payment made by complainant against above said bill is subject to adjustment and OP is restrained to disconnect the above electricity connection on payment of the 1st installment.
However, it is clarified that if complainant fails to deposit installments as per above schedule, the OP shall be within its rights for recovering the remaining outstanding amount or to take appropriate action as per law.
The complaint is disposed of in above terms. File be consigned to record room.
