The appellant is the opposite party in CC.247/09 in the file of CDRF, Idukki.  The appellant is under orders to replace the mini power sprayer or refund Rs.7,842/- the cost of the same and also to pay Rs.1,500/- towards cost.  The appellant/opposite party was exparte before the Forum.  In the circumstances and in view of the fact that the matter has been disposed of uncontested the order of the Forum is set aside on condition that the appellant/opposite party pays a sum of Rs.5000/- to the complainant or deposit the same before the Forum which can be withdrawn by the complainant.  The Forum will issue notice to the complainant and dispose of the matter on merits after permitting the opposite party to contest the case.

The case stands posted before the Forum on 2/12/2010.

The office will forward copy of this order to the Forum.
