ORDER

The instant appeal is filed by the appellant against the judgment dated 30.12.2020 passed by the learned District Consumer Disputes Redressal Commission, West Tripura, Agartala in Case No.C.C.77 of 2019.

Today the matter is fixed for appearance of the respondents.

None appears on behalf of the respondents.

Mr. M.K. Arya, Ld. Advocate appears for the appellant in his usual fairness submits that he wants to withdraw the appeal in view of the judgment of this Commission in Appeal Case No.A/37/2018 (The Postmaster, Chandlodia Post Office, Ahmadabad, Gujrat and Anr. Vs Sri Suman Bepari) wherein both the State Commission, Tripura as well as the Hon’ble National Commission held that a complaint petition is not maintainable against the Postal Authority in view of Section 6 of the Indian Post office Act.

In view of the above, the instant appeal is disposed of as withdrawn with a liberty to file afresh, if so advised.
