Heard the Ld. Advocate for the complainant and the Xerox copies of documents so filed by the complainant. It appears that this case has been filed by the complainant against the Joint Secretary, Transport Department, Government of West Bengal, on the grounds that on 24.02.2021, Subham Bairagi, son of the complainant was expired on account of motor accident near Palsit Station within P.S. Memari, and the complainant filed M.V. Death Claim along with F.I.R. of the said accident, which is still pending before the Transport Department and it was informed on 21.11.2022 by one Ld. Advocate that it was seemed that the case would not be fruitful.
On perusal of the documents and fact of the case in the complaint, we find that the complainant is not at all “Consumer” under the Consumer Protection Act, 2019 and we do not find any prima facie case to admit it under the Consumer Protection Act, 2019.
Hence it is
Ordered
that this case be and the same is not admitted and thus disposed of.
Let a copy of this order be given to the complainant on free of cost.
