Smty Nakiam Perme appeared Ld. Counsel Shri Elijah Taying remain absent. On Dated 09/10/22 Ld. Counsel Adv. Elijah Taying appeal the court to allow the case for mutual settlement outside the court under Section 37 of the Consumer Protection Act 2019. Accordingly, the court allow Shri Miram Perme and Tony Perme to lead, assist and make submission with case Shri Tony Miram Perme versus M/S Titu Optical, Pasighat. And also allow the prayer of Ld. Counsel Shri Elijah Tayng on behalf of Titu Optical, Pasighat for settlement and directed the parties to give in writing within five days, consent to have their dispute settled by mediation in accordance with the provision of chapter v of consumer Protection Act, 2019. Accordingly, the complaint party served a summon to M/S Titu Optical on 2nd nov 2022 and 9th Nov 2022 for mutual/ amicable settlement but he remains absent in the said meeting. The case is dismissed for default of non-appearance of respondent party and the respondent is ordered to reimburse the cost of the spectacle for an amount of Rs. 7500/-(Rupees seven thousand five hundreds) only with interest rate of 9 % from the date of purchase of the spectacle till realization. In additional the court order the respondent to pay Rs. 25000/- only to the appellant as compensation for the litigation expenses and harassment caused to the appellant.
