Mr. B.K. Singh, learned counsel, appearing for the complainant is present. Mr. A.K. Gupta, learned counsel for the opposite party No. 1 is also present.
Both the counsels refer to the application filed by the complainant Sri Bapan Bhowal supported by an affidavit and the relevant portion of the application is reproduced here-in-below;
‘That the applicant has arrived at mutual settlement with the Tinsukia Development Authority, the opposite party No. 1 and as such does not want to pursue the present complaint case further. In view of the above, the applicant prays for withdrawal of the present complaint case.’
As per such contention, the complainant had arrived at a mutual settlement with the opposite party No. 1 and as such, he does not want to pursue the complaint further.
In view of the submission made by both the learned counsels couple with the statement made by the complainant, supported by an affidavit, we dispose of this complaint petition on withdrawal.
Interim order, if any, stands vacated.
