By Smt. Padmini Sudheesh, President

The case of complainant is that he is a consumer of respondents vide consumer No.7903. The electricity connection allotted to the complainant is for non domestic purposes. The complainant received notice dated 17/9/03 demanding to pay Rs.5757/- as arrears of electricity charges. But the complainant has no arrears and he is not liable to pay the bill amount. He had sent Exhibits P4 and P7 letters to the Corporation and the Corporation sent replies and marked as Exhibits P5 and P8. But the notice is not set aside. Hence this complaint.

            2. Both the respondents are called absent and set exparte.

            3. In order to prove the case the complainant filed affidavit and documents which are marked as Exhibits P1 to P8.

            4. The complaint is filed to get cancellation of Exhibit P3 notice. According to the complainant he has no arrears in electricity charges. But the respondents issued Exhibit P3 notice to pay Rs.5757/- as arrears. Being a prompt consumer the complainant has no arrears in payment of charges.

5. There is no evidence to the contrary.

6. In the result the complaint is allowed and Exhibit P3 notice stands cancelled. There is no order as to costs and compensation.
