          The case is that the respondents had approached the complainant and stated that the respondents are conducting monthly deposit scheme with a monthly installment at the rate of Rs.500/- commencing on 10-10-2007 and will be matured on 10-1-2011.  Believing the words and assurances of the respondents, the complainant had subscribed in 2 deposit schemes and he has paid all the 40 installments in both the schemes.  After the maturity of the scheme, on 11-2-2011 he had approached the respondent and demanded back the deposit amount but the respondents not returned so far.  Hence the complaint.

2. The respondents are set exparte.

3. The complainant filed affidavit and Exhibits P1 and P2 marked.    4.There is no evidence to the contrary.

5. In the result, the complaint is allowed and the respondents are direct ed to return the amount of Rs.38,000/- at the rate 12% interest from the date of filing of the complaint till realization with cost Rs.1000/- within 2 months from the date  of receipt of copy of this order.
