ORDER

By Smt. Padmini Sudheesh, President: Complainant was a consumer of respondents vide No.1/2573/9651. The complainant has paid the electricity bills properly and no arrears. But respondent issued a notice to complainant demanding Rs.42,077/- towards electricity charge up to 12/02 and Rs.12,257/- towards additional charge. Upon receipt of the notice he had approached the respondents and directed to remit Rs.12,257/- only and nothing. As per that complainant had remitted Rs.12,257/- on 15.5.07. He has no liability to pay the electricity charges of Rs.42,077/-. If it is so, the amount is time barred. Respondents have no right to seek this amount. There is deficiency in service. Hence this complaint. 2. Respondents remained absent and set exparte. 3. To prove the case complainant has filed affidavit and documents, which are marked as Exts. P1, P2 series, P3 and P4. 4. According to the complainant he is not liable to pay the amount shown in Ext. P1 notice. He remitted the arrears of Rs.12,312/-. The receipts are produced and marked as Exts. P2 series. He also claims compensation of Rs.10,000/-. 5. There is no evidence to the contrary. 6. In the result, complaint is allowed and the respondents are directed to cancel the claim of Rs.42,077/- and further directed to pay Rs.1000/- (Rupees one thousand only) towards costs. Comply the order within one month. Dictated to the Confidential Assistant, transcribed by her, corrected by me and pronounced in the open Forum, this the 30th day of August 2008.
