            The case of the complainant is that she purchased a churidar material from the opposite party for Rs.1650/-.  After purchasing the material, complainant came to know that the material was a defective one.  Hence complainant is seeking relief against the opposite party to take back the material and to return the amount along with compensation.

            After serving notice, opposite party was called absent and set exparte.

            Complainant represented through her father Abdul Azeez with authorization.  Authorised person was examined as PW1 and Ext. A1 was also marked on the side of the complainant.  Churidar was marked as MO1.  After noticing the defect, Forum was convinced of the defect occurred in MO1.  Hence MO1 returned to the complainant.

            While examining PW1, he deposed that the complainant had purchased the churidar material from the opposite party for an amount of Rs.1650/- on 1.5.2009.   After making Churidar, complainant used it only once and that day itself she noticed the defects.  Even though the defect was brought into the notice of the opposite party, opposite party did not care about either to replace the churidar or to return the amount.

            From the deposition of PW1 and from Ext. A1 and MO1, complainant’s case is proved.

            In the result petition is allowed and the opposite party is directed to return an amount of Rs.1650/-, the total value of the churidar material with a compensation of Rs.400/- and a cost of Rs.200/- to the complainant.  Comply the order within one month from date of receipt of the copy of this order.

            Pronounced in open Court this the 31^st day of July 2009.
