ORDER
SRI.P.V.JAYARAJAN: PRESIDENT
This is a complaint filed under section 12 of Consumer Protection Act 1986 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:
This is a complaint filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties. After admitting the complaint notice was issued to the opposite paries. The 1st opposite party entered appearance and filed written version denying the allegation of deficiency in service raised by the complainant against the opposite parties. Though the 2nd opposite party filed Vakkalath, subsequently failed to file version and as there was no representation for 2nd opposite party, and no version was filed by the 2nd opposite party on 24/09/2013 this Commission declared 2nd opposite party as ex parte. When the case came up for consideration to day, it is noticed that the complainant is continuously absent. More over notice was issued by this Commission to the complainant for his appearance to proceed with this complaint. Even after accepting the notice, the complainant failed to appear before this Commission. In the above circumstances we find that the complainant is not willing to further proceed with this complaint.
In the result the complaint is dismissed for default. There will be no order as to cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
