The appellant is the opposite party in CC:307/08 in the file of CDRF, Kasaragod.  The appellant stood exparte before the Forum.  It is submitted that the appellant was laid up and hence could not contest the matter. The order contains, according to him a very damaging statement that he has appropriated advance amounts from hundreds of unidentifiable consumers which he wants to be expunged.

2. In the circumstances the order of the Forum is set aside on condition that the appellant pay a sum of Rs.5000/- to the complainant towards cost or deposit the same before the Forum which can be withdrawn by the complainant.

3. On payment of cost as ordered above, the Forum will issue notice to the complainant and permit the opposite party to contest the matter.  The case stands posted before the Forum on 9/6/2010.

The office will forward a copy of this order to the Forum urgently.
