JUDGMENT

                      The complainant  being the widow  of late Hemanta Kumar Mohapatra who was an employee of OP.2 died on dt . 07.07.2007. After his death the complainant is availing  P.F. and pension benefit as per Rules. After one month of death of Hemanta Kumar Mohapatra, the complainant gave birth to a male child on dt.15.08.2007. Accordingly as per the miscellaneous  provision  Act 1952 , the complainant submitted his claim before the OP 1 through OP 2 for P.F. benefit in favour of her posthumous child  Aditya  Mohapatra . But the OP 1 has not settled her claim. Hence the complainant.

 

                  Although OP 2 appears in this case he did not choose to file his version. OP 1 contested the case by filing his version.  Accordingly  to OP 1 due to non- supply of required documents the claim has not been settled.  O.P.2  participated  with the hearing of the case and claims no liablity.

 

                                       Heard the complainant.  The OP1 is  absent. On perusal of the material available on record and on own admission of the OP1  the complainant is entitled to the P.F. benefit for her  minor son Aditya Mohapatra.

 

                                     Hence the OP1 is directed to settled the pension benefit in favour of the  minor  son of the complainant  Aditya Mohapatra, within one month from the date of  receipt of this Order.  Further the OP1 is directed to pay Rs.1000/- One thousand only towards cost to the complainant, within the said time.

 

          Pronounced in the open Forum  to-day  i.e the  18th  day of   February ’  2020.
