Complainant and JDr present.  Heard.  It is seen that Shivachandar who had taken loan from the Decree Holder to whom JDr has undertaken to recover from his salary is dead and died without leaving any other, being unmarried. Brother of Shivachandrar one R.Sathyavelu has filed P&SC No. 10/2011 before the Learned Civil Judge (Senior Division), KGF and the matter is still pending there for adjudication.  DCRG of the deceased is still pending with the Government to be disbursed in accordance with Law, so also his PF.  Hence, Decree Holder is at liberty to move before the Learned Civil Judge (Senior Division), KGF in P&SC No. 10/2011 claiming the amount due which has been ordered in this case to be paid to him for which this Order will not come in the way. 

 

Hence, this Execution Application is disposed off.
