Petition filed on behalf of the Complainant school through it’s representative Sri A. Majhi Principal of the said school is taken up for hearing.  O.Ps. are found absent without any step.  Copy of this petition for dismissal of this case has not been served to the other side for their non-availability in this Forum.

It is now 11-45 a.m. on repeated calls neither the O.Ps. nor their advocates is found present.  Sri A. Majhi representative of the school is present.  Petition filed for dismissal of this case by the Complainant is taken up for hearing.

Heard Sri Majhi representative of the school.  Perused the petition filed for dismissal of this complaint by the Complainant and the materials on record.

It appears that the Complainant school does not want to proceed with this case as the alleged dispute involved in this case has been settled out of Forum / Court among the parties;  so, this Complainant school does not want to proceed with this case as such he has filed this petition for dismissal of this case for non-prosecution.

Considering the above facts & circumstances and as the dispute involved in this case has been settled among the parties.  So, we do not find any impediment to allow the petition filed by the Complainant for dismissal of this case for non-prosecution as the dispute / the matter has been settled and Complainant school has lost it’s interest to proceed with this complaint further.

Hence, it is

The Consumer Complaint Case no.07 of 2015 be and same is hereby DISMISSED FOR NON-PROSECUTION ; BUT WITHOUT COST.
