The appellant in Appeal No. 175/2022 seeks review of our order dated 04.07.2022 dismissing I.A. No. 427/2022,i.e; petition to condone the delay in filing the appeal. Consequently Appeal No. 175/2022 was also dismissed as barred by limitation.
2. As per the said order, we have dismissed the petition to condone the inordinate delay of more than three years and eight months in preferring the appeal. We have passed the order on the merits after elaborately considering the explanation stated in the affidavit filed along with the petition. We have found that the explanation contained in the petition was grossly insufficient to explain the inordinate delay that has occurred in filing the appeal. The review petitioner seeks review of the said order.
3. We have considered the affidavit filed in support of this petition and also heard both the counsel. As stated by the counsel for the respondent, the reasons stated in this petition are not correct. It is at the request of the counsel for the appellant/review petitioner that the case was listed for online hearing and it was his duty to note the proceedings and attend the case online without fail. The case was posted for hearing on 13.06.2022, 27.06.2022 and again on 04.07.2022 and on that date even though there was no representation on the part of the petitioner, we have passed the order on the merits after considering all aspects stated in the affidavit filed along with the petition. The learned counsel for the review petitioner has not been able to point out any error on the face of the record. No sufficient reason is made out to warrant a review of the order dated 04.07.2022, as sought for in this petition.
In the light of the above discussion, we find no grounds to admit the review petition or grant the prayer for review made by the petitioner. The review petition is therefore dismissed. No costs.
