Complainant submitted that complainant’s daughter was studied at the 2nd opposite party college for PG English during the year 2016-2018.  During that period complainant’s daughter was eligible for scholarship of one girl child and due to the negligence of the 2nd opposite party the scholarship was not received.  Hence the complaint.

Opposite parties filed version contending that the complaint is not maintainable before the Forum. As per the submission of opposite parties preliminary issue of maintainability heard.

 

In Maharshi Dayanand University Vs. Surjeet Kaur, (2010 (11) SCC 159) Hon’ble Supreme Court held that education is not a commodity and educational institutions are not providing any kind of service. Such maters cannot be entertained by the consumer fora under the Consumer Protection Act.

 

Under the above circumstances preliminary issue found in favour of opposite parties. The Forum lacks jurisdiction to entertain this complaint.  Hence complaint is dismissed without going to the merit of the case.
