Final Order / Judgement

Sri Sibasis Sarkar, President, DCDRF, Jalpaiguri

The complainant is present by filing hajira through his Ld. Advocate. The complainant has also filed a petition praying for permission  to withdraw the case with a liberty to sue afresh.

The petition is taken up for hearing. Perused the petition and other materials on record. Heard the Ld. Lawyer for the complainant.

It appears to us that there are some technical defects as a result of which the case may fail. As such the complainant must get an opportunity to sue afresh. Accordingly the petition is considered and allowed.

            Hence it is

ORDERED

that the consumer case no. 46/2017 be and the same is withdrawn with a liberty to sue afresh. The case is thus disposed of.

Let the documents if any and the extra sets filed by the complainant  be returned on proper receipt.

Let a plain copy of this order be supplied to the complainant free of cost.
