  ORDER.

            The present disputes arises out of the complaint petition filed by the above named complainant  alleging deficiency in service  against the afore said O.Ps for disconnected the telephone connection on Dt. 16.7.2015 without prior intimation.

               On being noticed the O.Ps.  appeared  in person before the forum and filed  written version and submitted  that  they had  issued a bill amounting  to Rs. 1,046/- in favour of the  complainant towards telephone No.231917 for the month of  June, 2015  those  payment  due date was 27.6.2015.  But  the complainant failed to deposit the same amount in due date. In between bill for the month of July, 2015  was prepared amounting to Rs.1482/- which includes current bill amount  of Rs.436/- and arrear of Rs. 1046/- for June, 2015 whose payment  due date  was 27.7.2015.  But  due to non  payment of  Bill for the month of June, 2015 amounting to Rs. 1046/- the both way disconnection  of telephone was  made  on 16.7.2015.  The complainant  paid the full amount of Rs.1482/- on Dt.27.7.2015 .  After  receipt of the  due amount the O.P.  immediately  restored the  telephone connection  of the  complainant  on Dt.27.7.2015. The O.Ps submitted that  there is no deliberate  deficiency of service on the part of the O.Ps.  The O.Ps  prayed the forum to dismiss the complaint petition against the O.P. No. 1 & 2 for the best interest of justice.

The O.Ps 1 & 2   appeared and filed their written version.  Arguments from the O.Ps   and from the   learned counsels for   the complainant  heard.   Perused the record, documents, filed by both  the parties. 

            The  learned counsel  for the O.Ps. vehemently advanced arguments touching the points both on the facts  as well as on  law.

 

 

           FINDINGS.

                On perusal of the written version filed by the O.Ps it is revealed that  due to  non  payment  of  outstanding  telephone bill for the month of June,2015 in due  date i.e. 27.6.2015 the  O.Ps disconnected the  telephone connection on Dt. 16.7.2015 which is a normal procedure  carried automatically   by computer system.  Further it is observed after  receipt of the  outstanding  amount  from the complainant the O.Ps  had  immediately  restored the  telephone connection  of the  complainant  on Dt.27.7.2015.  So  it is  observed  there is no deliberate deficiency of service on the part of the O.Ps.

 Hence to meet  the  ends of justice the following order is passed.

ORDER.

In the result with these observations, findings  the complaint petition is dismissed against  the O.Ps.  Parties are left to bear own cost.

Accordingly  the  above case is closed.
