Final Order / Judgement

Record is placed before the Lok Adalat as per order dated 18.09.2024 for settlement of the matter.

Both the parties are present.  It has been submitted for the complainant that the matter of dispute in between the parties has already been settled. A petition has already been filed by the complainant on 09.09.2024 with the prayer for permission to withdraw the Consumer Complaint. Copy has already been served. It reveals that the said petition was registered as MA/418/2024 on that date.

On scrutiny of the complaint petition it appears that the complainant filed the instant the case on 03.05.2023 against the OPs the Tata Motors Finance Ltd. for deficiency in service as well as unfair trade practice with the prayer for passing an order directing the OPs (i) not to seize the schedule vehicle from the custody of the complainant, (ii) to discontinue such unfair trade practice and not to repeat it to the unidentified innumerable consumers (iii) to pay litigation cost of Rs.30,000/- and to pay punitive damage of Rs.2,00,000/- along with a compensation to the tune of Rs.50,000/-.

Having heard the parties present and the documents filed by them in the instant case, it appears to us that the matter has already been settled in between the parties.  

Hence, the CDF Unit-II, CC No. 106/2023 is settled and disposed of finally through the Lok Adalat and the MA/418/2024 is also disposed of.

Let a copy of this order be supplied to both the parties free of cost with proper endorsement.
