Ld. Advocate for the complainant is present .heard Ld.Advocate for the complainant on admissibility of the consumer complaint.
On perusal of the petition it is observed that the complainant applied for loan and the same is received of Rs 18,35,000/ (Rupees Eighteen lakh thirty five thousand ) only from the OP 2 ( The M/S CHOLAMANDALAM INVSTMENT & FINANACE CO.LTD.) vide a loan agreement no.XSHUMAL00002973394 dated 18/05/2019 for the purpose of purchasing a vehicle.The said vehicle was purchased ( Details of the vehicle:- Goods Carrier,Tata Motors Limited,registration no.WB65C4331 dated 13.10.2017).The complainant was regularly paid the EMIs but some of the EMIs missed due to financial constraint for Covid-19 Lock down The driver of the vehicle OP3 mislead the complainant and took out the vehicle with all documents from the custody of the complainant for which the complainant filed a civil suit before before the 2nd Civil Judge (jr.Div) at jangipur but the same was dismissed uncontested.The complainant informed the matter to OP1 (The TATA AIG GENERAL INSURANCE CO.LTD).who were assured the complainant about the claim since the schedule vehicle lost within the insured period.
No documents annexed with the complaint petition regarding the details of the vehicle as mentioned in the complaint petition.
Registration certificate of the vehicle,policy schedule cum certificate of insurance of the vehicle and terms and conditions,Loan details,FIR,Case details as mentioned in complaint petition.which are necessary to establish the complaint application .
In view of the above observation and lack of above mentioned documents we are not inclined to admit the consumer complaint in its present form and accordingly the same is rejected.
The CDF-II CC being No.156/2023 is thus disposed of. The MA/298/2023 stands dismissed.
