- The Complainant sought for information under the Right to information Act, 2005 and when not got any information then filed first appeal before the O.P. On 10.07.2023. The O.P. directed the Complainant to apply for certified copies. The Complainant applied for certified copies of Mutation Case No. 6167/2022 in copy application No. 1302/25.09.2023, Mutation Case No. 6166/2022 in copy application No. R1303/6166/2022 in copy application No. R1303/25.09.2023 and LRMS NO. 6759/2022 in copy application No. 1298/25.09.2023. The O.P. till date not provided and harassed the Complainant. Being aggrieved this Complaint has been filed.
- The Govt. pleader, Sri. A.K. Senapati appeared on behalf of the O.P. but not filed any version.
- Perused the documents filed by the Complainant. The Public Information officer, advised the Complainant vide letter No. 153 dated 23.06.2023 & 192 dated 02.08.2023 to apply for certified copies. The Complainant applied for certified copies vide Revenue application No. 1302 dated 25.09.2023, 1303 dated 25.09.2023 and 1298 dated 25.09.2023. Till date the certified copies are not provided nor it was rejected by the O.P. and it is pending since 25.09.2023. Being aggrieved this complaint has been filed.
- The Learned G.P. submitted that the Complainant is not a consumer of the O.P. The Complainant in reply submitted that to obtain information Rs. 10/- fees has been paid and further while certified copies were applied Rs. 6/- x 3 =Rs. 18/- has been paid to the O.P. The G.P. not denied the facts of receiving the fees for application. As the O.P. received fees and granted receipts of application numbers the Complainant is a consumer of the O.P. The O.P. failed to substantiate their case why delay has been made and certified copies were not supplied although urgent fees has been paid. Non supply of certified copies within time amounts to deficiency in service on the part of the O.P. The O.P. also failed to intimate the Complainant the cause of delay.
Taking into consideration the circumstances of the case following order is passed:
ORDER
The complaint is allowed against the O.P. The O.P. is directed to supply certified copies of Mut. Case No. 6167/2022 and BeBandobastCase No. 54/2017 & LRMS NO. 6759/2022 sort for by the Complainant within one month of this order. In-case of non-supply the O.P. shall intimate the reasons of non-supply so that the Complainant shall take recourse under the Law. For deficiency in service the O.P. is liable to pay compensation of Rs. 5000/- and litigation expenses of Rs. 5000/- to the Complainant.
Order pronounced in the open court on 21st day of Oct. 2024.
