Heard the learned counsel for the both the parties present. This complaint is filed alleging negligence and deficient service there on the part of the O.P. The complainant seek for an order directing the O.P to initiate mutation  proceeding and disposed off the same within the stipulated period of  time and for an award of compensation of Rs.30,000/- towards harassment and mental agony and further to award exemplary cost  of Rs.50,000/- payable to the consumer welfare fund.

Brief facts of the case is that , in pursuant to order dt.06.12.2023 of the Hon’ble Court of Permanent Lok Adalat ,Kalahandi ,Bhawanipatna the complainant had applied four number of  mutation case before the O.P paying required service charge of Rs.80/- each for processing of the mutation. But the O.P has neglected to initiate the mutation proceeding resulting mental agony and harassment to the complainant. Hence this complaint.

On being notice the O.P appeared and filed their written version containing the fact that, mutation case No.2650/2024,2651/2024,2652/2024 and 2654/2024 has already initiated and notice is issued to the parties on 01.07.2024 fixing the date of hearing and first hearing of the mutation cases have been conducted on 12.07.2027. On the date fixed the petitioner has appeared before the O.P and prayed for an adjournment to submit their relevant documents to conclude the mutation proceeding.

Based on the above fact and circumstances we are of the opinion that, the O.P have already acted   upon the application of the complainant and mutation proceeding has already been initiated as such we do not think it proper to proceed anymore in this case. Hence, the case is dismissed against the O.ps as complied.
