            Today is fixed for necessary order.

            No step taken by the complainant. None appears on behalf of the complainant during its call. Ld. Counsel for the OP -1 is present by filing hazira.

            It is evident from the record that on the previous date the ld. Counsel for the OP-1 appeared by filing vokalatnama and filed two letters, one from the Post Master – Raniganj Head Office dated 16.01.2019 to the Senior Superintendent of Post Offices, Asansol Division and another from the Senior Superintendent of Post Offices, Asansol Division, Asansol – 713 301 dated 21.01.2019 stating that the Ops have already issued duplicate KVP on 11.01.2019 and maturity value including admissible interest up to 15.01.2019 has been paid to the complainant and he has no grievance and prayer is made for disposal of the complaint.

            It is evident from the letter of Post Master – Raniganj Head Office dated 16.01.2019 to the Senior Superintendent of Post Offices, Asansol Division that “it is intimated by the SPM, Andal MDG that the duplicate KVP in r/o. No. 03CD814110 under Regn. No. 17925 has been paid to Sri Sachidanand Singh on 15.01.2019 for Rs. 26,825=00 by cheque No. 429455 dated 15.01.2019”.

The Senior Superintendent of Post Offices, Asansol Division, Asansol – 713 301 in his letter dated 21.01.2019 in c/w letter dated 16.01.2019 of Post Master – Raniganj Head Office that “KVP has been issued on 11.01.2019 and maturity value including admissible interest up to 15.01.2019 has been paid to Sri Sachidananda Singh under clear receipt and at present he has no grievance and requested to disposed off the instant case on the next date”.

This Forum is of the opinion that as the complainant has received the maturity amount along with up to date interest on his KVP, he has lost interest to proceed with the complaint further and for that reason he has not taken any step today.  As the grievance has already been mitigated by the Ops, we are of the opinion that the present complaint should be dismissed for non-prosecution.

Hence, it is

O r d e r e d

that the present Consumer Complaint being No. 193/2018 be and the same is dismissed for default due to non-prosecution without any cost.

Let plain copies of this order be supplied to the parties free of cost as per provisions of law.
