During the course of the sitting of the Commission at Dimapur, this petition was filed by Smti. Akin Toulazo, praying for dismissal of the restoration petition filed by the appellant.

            Register it as a misc case.

            Heard Shri Pakinrichapbo, learned counsel for the Complainant. According to the learned counsel the Complainant case No. CFD 3/2013 was allowed by vide judgment and award dated 20/05/2015, passed by the District Forum, Dimapur. Against the said judgment the Superintendent of Post Office Kohima, and others filed FA No. 1/2015 before the State Commission

            The said appeal was dismissed for default on 16/10/2015. Thereafter the appellant filed a restoration petition which was registered as CMC 5/2016.

            Pending disposal of CMC 5/2016 (restoration petition).

            The office of the State Commission was burned down in the month of February, 2016 and entire record was destroyed.

            Thereafter, the State Commission issued a public notice for filing restoration case before the State Commission. However, the appellant failed to submit reconstructed records, there by delaying the disposal of CMC 5/2016. Resultantly, the Complainant is also unable to execute the award.

            On 26/06/2018, the learned counsel for the appellant prayed for 4 weeks time for filing reconstructed record. However, till date the appellant has not filed reconstructed records.

            Accordingly, it is ordered that CMC 5/2016 stands dismissed and the dismissal order of FA 9/2015 is maintained.
