This is a complaint filed by the complainant against the Op Sub-Registrar with allegations that the subject matter is an immovable property was originally belongs to one Rajgopal who sold to G. Manohar Rao in the year 1999 who in turn gifted that property in favour of Smt. G. Lalitha in the year 2004.   Earlier documents were duly registered in Op office.   It is the further allegation of the complainant that Mr. Rangappa  subsequently gave GPA in favour of Mr.K.N. Prakash for developing some land and after formation of layout, sold sites in favour of intended purchaser without any authority and Sub-Registrar has duly registered those documents in their office and thereby committed fraud and cheating and has caused deficiency in his service and has prayed for damages of Rs.1.00 lakh.

 

          As could be seen from the allegations of the complainant, the issues do not come within the purview of the consumer forum as the Op is a public servant is discharging his official duty.   If he has indulged in such illegal act, the remedy to the complainant is elsewhere but not under the provisions of the act.   This forum under the act cannot enter into whether the Op is right or wrong in doing such act and to award damages.

 

          Therefore, the complaint in our view is not maintainable under the act and the same is dismissed at the stage of admission.
