The present disputes arises out of the complaint petition filed by the above named complainant alleging deficiency in service against afore mentioned O.Ps for non payment towards 2 No. S.B. accounts and M.I.S deposited amount of parents. The brief facts of the case are summarized here under.
1) That the father of the complainant late Sudam Pradhani was an employee of the O.Ps at Muniguda was having S.B. account No. 7503132 and he died on 12.11.2007 and by that time he was having a balance of Rs.50,860/-. The mother of the complainant Late Jamuna Pradhani was having a monthly income scheme account vide No.3021053 having a fixed deposit of Rs.1,00,000/- and another S.B. account No.7502932 having a balance of Rs.38,475/-. She also died on 31.10.2010. After obtaining death certificate and legal heir the complainant was applied to the O.P to get the above amount as a legal heir, but the O.Ps paid deaf ear for some or other plea and the complainant approached the authorities from pillar to post. Hence this case. The complainant prays the forum direct the O.Ps to make the aforesaid payments to the complainant / legal heirs with accrued interest and such other relief as the hon’ble forum deems fit and proper for the best interest of justice.
2.On being noticed the O.Ps filed joint written version and submitted that the facts which are not specifically admitted may be treated as denial of the O.P. The O.Ps taking other grounds in the written version sought to dismiss the complaint as it is not maintainable under the C.P. Act, 1986 and there is no deficiency in service on the part of the O.Ps. Hence the O.Ps prays the forum to dismiss the case against them to meet the ends of justice.
The O.Ps appeared and filed their written version. Heard arguments from the complainant and O.Ps. Perused the record, documents, written version filed by the parties.
The parties advanced arguments vehemently opposed the complaint touching the points both on the facts as well as on law.
FINDINGS.
3.There is no dispute that the complainant is the son of Late Sudam Pradhani and Late Jamuna Pradhani. Late Sudam Pradhani was the holder of Muniguda Sub-post office S.B. account No. 7503132 with a closing balance of Rs.50,860 as on date of his death i.e. Date.12.11.2007. Further there is no dispute Late Jamuna Pradhani was the holder of Muniguda Sub-post office MIS account No. 3021053 opened with an initial deposit of Rs.1,00,000/-. She also the depositor of Muniguda Sub-post office,SB account No. 750932 with a closing balance of Rs.38,475/- as on her date of death i.e. on Dt.31.10.2010.
On perusal of the written version filed by the O.Ps it is revealed that the O.Ps contended that due to non submission of the following documents the claim of the complainant is not yet settled.
2.Depositor has not submitted total holding certificate.
3.As the sum total of the three claims exceeds one lakh rupees, depositor should furnish succession certificate from the competent authority.
4. SPM., Muniguda should counter sign all the claim documents.
At this stage this forum observed the interest of justice would met if the O.Ps. received all the documents filed by the complainant relating to the case from the complainant and be settled the matter and to make the aforesaid payments i.e. S.Bs and M.I.S with accrued interest.
In view of the above discussion relating to the above case and In Res-IPSA-Loquiture as well as in the light of the settled legal position discussed as above which is justified. The claim of the of the complainant is genuine and bonafied to and are entitled to get the reliefs sought for. Hence we allow the above complaint petition in part.
To meet the ends of justice, the following order is passed accordingly. ORDER.
In resultant the complaint petition is allowed in part on contest against the O.Ps.
4.The O.Ps ordered to receive all the documents pertaining to this case from the complainant and settled the matter at their level inter alia to pay make the aforesaid payments i.e.2 No. S.B. Accounts and MIS account with accrued interest to the complainant with in time frame . The complainant is directed to submit all the documents pertaining to the above case to the O.P. immediately. Parties are left to bear their own cost.
The OPs ordered to make compliance the aforesaid Order within reasonable period of time.
Serve the copies of above order to the parties free of cost.
