JUDGMENT
The curx of the case is that the above named complainant alleging deficiency in service against afore mentioned O.Ps for non issue of duplicate R.D. pass book inter alia transfer the same pass book from Therubali to Kalyansingpur post office for which the complainant sought for redressal of the grievances raised by the complainant.
On being Noticed to the O.Ps the O.P. No. 4 appeared in person before the forum and stated that being the operational head of Koraput postal Division is competent to file the reply on behalf of all the O.Ps inter alia filed written version refuting the allegation made against them. The O.Ps taking one and other pleas in the written version sought to dismiss the complaint as it is not maintainable under the C.P. Act, 1986. The facts which are not specifically admitted may be treated as denial of the O.Ps. Hence the O.Ps prays the forum to dismiss the case against them to meet the ends of justice.
The O.Ps appeared and filed their written version. Heard arguments from the O.Ps and from the complainant. Perused the record, documents, written version filed by the parties.
This forum examined the entire material on record and given a thoughtful consideration to the arguments advanced before us by the parties & vehemently opposed the complaint touching the points both on the facts as well as on law.
FINDINGS.
Undisputedly the complainants Sri A.Hari Krishna Rao and his wife Smt. A. Sanjeeva Ratnam had opened one Joint-B type Recurring deposit account No.981288. Again there is no dispute the complainants had deposited of denomination Rs.500/- at Therubali Sub-post office on Dt. 31.10.2012. A loan amounting to Rs.5,000/- was taken by the complainant during july, 2014 and as on Dt. 16.6.2015 the accrued balance in the said R.D. account was Rs.14,250/-. Further there is no dispute the complainants had applied for transfer of their R.D. account standing at Therubali Sub-post office to Kalyanasinghpur Sub-post office and also requested for issue of duplicate passbook in lieu of lot one.
The O.Ps in their written version para No.1 contended that the applications tendered by the complainants was duly endorsed by the Sub-post Master, Therubali S.O. to Rayagada Head post office for issue of duplicate pass book and effecting transfer. At that time Rayagada Head post office was migrated to Corebanking Solutions(CBS) and Kalyansinghpur as not upgraded to CBS. As such instant transfer of the RD account to Kalayansinghpur could not be effected by the Postmaster, Rayagada HO due to methodological stringencies & error.
The O.Ps in their written version para No.2 submitted that the O.P. No.4 vide his order dated 19.12.2017 directed the O.P. No.1 to look into the grievance of the complainant and sanction was accorded for effect payment of accrued sum to the complainants( copies of the order is in the file which is marked as Annexure-I). Accordingly an amount of Rs.17,459/- has been paid to the complainant on 6.1.2018 by the S.P.M., Therubali, S.O. being the maturity value of RD account No. 981288 with admissible interest(copy of the Lr. Dt.6.1.2018 of O.P. No.1 is in the file marked as Annexure-2.
This forum observed the O.Ps. after receipt of notice from the Forum promptly have paid Rs.17,459/- to the complainant and there is no deficiency in service on the part of the O.Ps. The present case in hand the complainant is not entitled any compensation from the O.P.
To meet the ends of justice the following order is passed.
ORDER.
Accordingly the case stands disposed off. There is no order as to cost and compensation.
