J U D G M E N T.

In the matter of an application filed by the complainant alleging deficiency of service against the Opposite Parties under Consumer Protection Act, 2019.
Brief fact of the case is that, the complainant is one of the legal heirs & successors in interest of his father Late Ramakanta Nayak. The said Ramakanta Nayak had one Saving Bank Account bearing No.628542 (Old) & 1014957830 (New) with O.Ps and C/F No.077219609 with the O.Ps. This complainant along with other legal heirs are entitled to said amount along with accrued interest as on date.
The said Late Ramakanta Nayak had 13 legal heirs. None of the parties have any dispute on this point. Further legal heir No.1 to 7 namely Aditya Kumar, Sitakanta, Radhakanta, Jatikanta, Pramila Samal, Chapala Nayak & Utpala Nayak had applied for part claim settlement & have given their consent to disburse their share (Legal heir No. 1 to 7) in favour of Aditya Kumar Nayak, the complainant. The O.Ps have no objection to it also.
Hence, it is ordered that the claim against S.B. Account No.628542 (Old) & 1014957830 (New) be calculated for its accrued interest and the same be aportioned into 13 equal parts and out of those 7 parts be paid to Sri Aditya Kumar Nayak, the complainant. The order be carried out within 30 days from the date of receipt of the order.
This order is pronounced in the open Court on this the 29th day of April 2023 under my hand and seal of the Commission.
