The case of the complainant is that the complainant is a bona fide consumer under Op no.1 . The complainant got bill 31.5.16 of Rs.17,736/- for two quarters . Rs.6720/- for 10.2.2016 to 28.4.2016 and Rs.13,016/- is for 10.11.2015 to 9.2.2016 . Objection was given by the complainant . The Op replied by letter dated 14.6.2016 with comment that result “found meter seen defective”. During that period the consumption unit was 1586 which was very high. From the date of last reading on 9.2.2016 total unit consumed 1583 against previous year reading 704. In this way complainant has written meter reading of different times. In para 8 also the complainant raised objection against bill of Rs.13,016/- which has not been considered by the oP. The complainant paid Rs.19,582/- with available rebate. The allegation of the complainant is that the OP is being well aware of the fact of defective meter did not rectify the bill stated hereinbefore. Hence, complainant has approached before this forum for adjustment of amount as per his calculation amounting to Rs.8,000/- has been demanded for refund along with other prayer. The complainant has filed some documents regarding letter addressed to Op for rectification of bill. 

            In this case also the oP did not appear and did not contest the case for which hearing the case exparte has been made on 19.12.2016 and thereafter 21.2.2017 the OP also did not take appropriate step . Accordingly, today argument has been heard from the complainant along with evidence exparte.

            The complainant has filed some Xerox copy of letter addressed to the Op and some electric bills Annexure A to F. In absence of oP there is nothing in record to disbelieve the statement of complainant . On the other hand, the letter addressed to Op (Xerox copies) shows

that the allegation of the complainant was well within the knowledge of the oP but Op with due diligent has avoided to redress the grievance of the complainant. It is very unfortunate at present day that the Govt. officials very much reluctant to see the need of the common people and lower middle class , particularly. Without any hesitation we are of opinion that complainant is entitled to get relief as prayed in para 14. Hence

            That the CC no. 127 of 2016 be and the same is allowed exparte. The Op is directed to refund or adjustment amount of Rs.8000/- . The Op shall give Rs.10,000/- for mental harassment to the complainant and Op shall give Rs.10,000/- towards litigation cost to the complainant. The oP company shall adjust the amount first and then pay the rest amount i.e. 20,000/- within 45 days from the date of this order, failing which complainant is at liberty to execute this order through forum.

            Let a copy of this order be given to the parties free of cost.
