Complainant is found absent on repeated calls. O.P. is represented by the Ld. Advocates. Ld. Advocate of the complainant fairly submits that he has no instruction. Regarding absence of the complainant repeatedly and may pass necessary order in this regard.

Heard, Ld. Advocate of the O.P who submits that since long back the complainant is found absent without taking any steps.

Having heard, the Ld. Advocate of the O.P. and on perusal of the entire record it reveals that the complainant is founds absent since long back.

                        Accordingly we are of the view that the complainant is not at all interested to proceed with this case furthermore.

Hence, it is

That the instant C.C. No. 77/2023 is hereby dismissed for non-prosecution.
