Hazira is filed on behalf of the Complainant through Advocate.
No step is taken by the O.P.
The case is fixed for argument.
After hearing argument the Commission proceeds to dispose of the case as hereunder: -
The complainant’s case is that he is a regular domestic consumer under O.P. with Consumer I/D 233119300 and the electric connection was installed in the premises of the complainant in the Year 2002 and since then he has been paying the electric bills regularly but on 17-04-2002 new Meter was installed and after change of the meter the complainant had been receiving bills since 2003 beyond normal consumption and the complainant from time to time made representations to the O.P. but of no effect and ultimately he went on depositing the bill amount on protest and exchanging letters with the O.P. on different occasions for adjustment of the excess payment but the scenario overall changed in the Year 2015 when the complainant received a Demand Notice from the O.P. dated: 19-02-2015 for Rs.16902.05 for the bill month August to October, 2014 with threat of disconnection. The complainant thereafter filed the instant case for appropriate relief.

The O.P. contested the case by filing written version denying all the material allegations made in the complaint contending inter alia that the complainant had outstanding dues since 2014 and so the Demand notice dated: 19-02-2015 was served upon him for payment of outstanding dues with Late Payment Surcharge (LPSC).
At the time of hearing Ld. Advocate appearing for the complainant has frankly submitted before the Commission that the complainant is ready and willing to pay the outstanding dues if any not exceeding Rs.3,000/-.
The Commission has gone through the entire facts of the case, submission and materials on record and come to the conclusion that it is purely a billing dispute mainly for outstanding dues for a long period since 2003 and LPSC has been added thereto and the amount has thus become bigger like 16,902.05 in the Year 2015. There is no way out for back calculation of electric consumption during this long period. It is therefore a fit case to apply Thumb rule in the interest of justice.
Accordingly the Commission fixes the outstanding dues to be Rs.3,000/- which the complainant will pay to the O.P. after receipt of the revised bill.
Hence it is ordered…….
That the case is disposed of on merit by directing the O.P. to withdraw the Demand Notice dated: 19-02-2015 and send revised bill for Rs.3,000/- and the complainant will pay the same within one month from the receipt thereof.
Both parties be supplied copy of this Order free of cost.
