    1. This is an application U/S 12 of the C.P. Act, 1986 filed by the petitioner, Sk. Mujit, praying for a direction upon the o.p. no. 1, Station Manager, WBSEDCL, and another to install new electric meter in the house of the petitioner at Unsani Garpa, P.O. Unsani, P.S. Jagacha, District Howrah, and compensation for Rs. 3,000/- for mental agony and Rs. 2,000/- as litigation costs.

The case of the petitioner is that he applied for installation of new electric connection in the above holding of the petitioner on 28.6.2014 and after inspection the o.p. sent quotation on 25.7.2014 and as per quotation the petitioner deposited the security deposit and energy charges amounting to Rs. 1,088/- but the o.p. did not install the new electric meter even though the petitioner requested them for a number of times. Electricity being essential, the o.p. cannot deny the same and so the petitioner filed this case.
  1. The o.p. WBSEDCL though served with notice did not appear in the case and thus the case is heard ex parte against them.

 

  1. The only point to be decided herein whether the petitioner is entitled to the installation of electric connection as prayed for and other reliefs ?

DECISION  WITH   REASONS      :

  1. In support of the case the petitioner filed affidavit as well as documents proving the fact that he made payment in respect of the security deposit as well as made payment in respect of the service connection charge as could be noticed from the documents filed by him and thus the affidavit filed by the petitioner supported by documents proved the case of the petitioner that he is entitled to get new electric connection in his residence. The above oral and documentary evidences went unchallenged and there is nothing to disbelieve the case of the petitioner.  

In view of above, the case of the petitioner is liable to be allowed ex parte.

Court fee paid is correct.      

      Hence,

                       O     R     D      E      R      E        D

           That the C. C. Case No. 584 of 2014 ( HDF 584  of 2014 )  be and the same is   allowed ex parte  with  costs  against  the O.Ps. 

      The O.P. no. 1, Station Manager, WBSEDCL, Andul Mouri, P.S. Domjur, is directed to install new electric meter in the house of the petitioner and render service connection therein and to pay Rs. 1,000/- as compensation for the mental agony and harassment of the petitioner and Rs. 1,000/- as litigation costs within  30 days from the date of this order  failing the petitioner is  at liberty to put the order  into execution after expiry of the appeal period.

             Supply the copies of the order to the parties, as per rule.
