The complainant’s case in brief is that,
The complainant applied for new domestic electric service connection to his residence at village-Paharichak, P.S. – Nandakumar, Dist.- Purba Medinipur. He deposited earnest money of Rs.200/- on 19.07.2011 and then further Rs.280/- on 16.03.2012 to the OP as per quotation. But the OP did not effect the service connection for long time inspite of several request causing mental agony and harassment, hence, the case.
The opposite party had contested the case by filling W/V and also filed WNA wherein all material allegations made against him had been denied. It is interalia stated by the OP that after inspection on 23.12.2011 it is found that to effect the said connection 6(six) P.C.C. poles are required for which proposal was sent to the Tamluk (D) Division on 14.01.2013 for effecting the service connection.

Whether the complainant is entitled to any relief as prayed for?

We have carefully gone through the photocopies of the document filed by the parties on record as also the W/N/A filed by the OP. Considered the submissions made by the Ld Advocates of both the parties.
Admittedly the complainant deposited earnest moneyof Rs.200/- on 19.07.2011 and Quotation money of Rs.280/- on 16.03.2012 as per quotation to the OP. but proposal to Tamluk (D) Division for seeking permission as to requirement of 6(six) P.C.C. poles for effecting such service connection was sent on 14.01.2013 i.e. after lapse of 9 months. In our considered view, such inaction on the part of the OP for long time without any cogent reason squarely points out deficiency in service. As such, the complainant is entitled to a direction upon the OP for effecting the aforesaid service connection to the residence of the complainant.
The above point is,thus, disposed in favour of the complainant.
ORDERED
That the instant complaint case be the same is allowed on contest against the opposite party with litigation cost of Rs.500/-. The OP is directed to effect the electric service connection in favour of the complainant at his residential premises, as already applied for, within 45 days from communication of this order failing which the complainant shall be at liberty to execute the said order in accordance with law. In case the opposite party fails to comply with the said order/direction within the stipulated period, the complainant shall be entitled to fine @Rs 100/- per diem to be paid by the opposite party from this day till compliance of this order.
