The complainant filed the instant case praying for direction upon the OP for effecting electric service connection in her dwelling house situated at Plot no. 286 of Betaldighi Mouza, Dist. – Purba Medinipur, and also for other reliefs on the principal ground that she deposited cost of Rs.650/- towards security deposit on 18.02.2010 as per quotation issued by the OP for the aforesaid service connection, but the OP did not effect the service connection for a long time, inspite of request made on the part of the complainant, hence the instant case.
The OP contested the case by filing W/V wherein all material allegations made against it have been denied. It is stated interalia that due to objection raised by one Haripada Bera and Smt. Arati Khatua, the OP could not effect the said service connection and that the OP has no latches on its part.
Point for consideration
Whether the complainant is entitled to get relief as sought for?

In order to substantiate her case the complainant filed documents of 02.08.2011 including Money Receipt of Rs.650/- as per quotation as also Arpannama and one Searching Report with regard to the plot in question. Though Examination-in-Chief on affidavit was filed by the complainant but the same was not tendered to give effect to the same.
Apart from that a Xerox copy of Parcha is also filed.
We have gone through the documents filed on record as well as the W/V filed by the OP. considered the submission of Ld. Advocates of both sides including the WNA filed.
Admittedly, the complainant is a ‘consumer’ under the OP and that she deposited Security Deposit in favour of OP for taking service connection in her dwelling house. On careful perusal of the materials on record, we are of the view that the OP has failed to show any cogent ground for non supply of electric connection in favour of the complainant. Mere raising of objection by any person without any cogent ground cannot be a hindrance for non supply of electric connection.
That being so, we find there is deficiency in service on the part of the OP for non supply of electric service connection in the dwelling house of the complainant and as such the complainant is entitled to get electric connection in her dwelling house as sought for in her complaint.
The aforesaid point is thus disposed of in favour of the complainant.
Hence, it is,
ORDERED
that the Consumer case being no. 08 of 2011 be and the same is thus allowed in part on contest with cost of Rs.500/- payable by the OP to the complainant. The OP is directed to effect aforesaid electric service connection in the dwelling house of the complainant, with police help, if necessary, within 30 days from the date of communication of this order including payment of cost, failing which, a fine of Rs.50/- per diem shall be imposed upon the OP from the date of this order till compliance of the order. The complainant will be at liberty to execute this order if the OP fails to comply with the order within the stipulated period as made above.
