Ld. Lawyer for the Complainant stated that in the prayer portion of the complaint one paragraph has not been written due to typographical mistake and the Complainant prays for insert that paragraph praying for the direction upon the O.P. for disconnection the service connection of the Complainant being service connection No. RD 350, Consumer ID no. 233123806. The Complainant also stated that by this amendment the nature and character of the case will not be changed.
Copy of the petition has been served. The O.P. has no objection about the amendment sought for.
We have verified the petition carefully. It is clear from the record that the Complainant had already mentioned the facts regarding disconnection of his service connection in the original complaint in point no.12. The documents show that the Complainant also submitted a letter requesting the O.P. to disconnect his service connection before filing this case on 12-05-2015.
Hence from the above discussion it is clear that the amendment required by the Complainant does not change the nature of the complaint. So, there is no impediment to allow the amendment petition of the Complainant.
Accordingly, the prayer of the Complainant is considered and allowed. Amend the plaint.
Thus the Misc. Case no. 30/2018 be and the same is disposed of.
