Complainant files a petition on the ground stated therein along with Vokalatnama.  Let the petition be registered as Misc. Case no.15 of 2018.

The Misc. Case is taken up for hearing.

Ld. Lawyer for the Complainant stated that during the pendency of this case the Complainant Sri Debi Prasad Banerjee has been died on 14^th January 2018 and under this situation the wife of Sri Debi Prasad Banerjee prays for substitute the name of the Complainant to her name.

We have heard Ld. Lawyer for the Complainant.  As per section 2(b)(V) of the Consumer Protection Act, 1986 in case of death of a Consumer, his legal heir or representative can be treated as Complainant.  So, the wife of Sri Debi Prasad Banerjee as legal heir can contest the case against the O.P. and we find no impediment to substitute the name of Sri Debi Prasad Banerjee to her.  Accordingly, the petition of the Complainant is allowed.  Amend the cause title.

Thus the Misc Case no.15 of 2018 be and the same is disposed of.

It appears from the track consignment filed by the Complainant on 11-12-2017 and from the A.D. Card that notice upon O.P. has been duly served and the O.P. received the same putting signature on the AD but does not appear to contest.  The case shall be heard exparte against him.

To 04-06-2018 for exparte hearing.
