1.                  The instant case was filed by complainant   U/S 12 of the  C.P.  Act, 1986,

as amended against the O.P.  alleging deficiency in service U/S 2( 1 )( g ),  2( 1 )( o ) of the C.P. Act, 1986 wherein the complainant has prayed for passing necessary direction upon the O.P, WBSEDCL Authority for adjustment the erratic energy bill sent to the complainant including other relief as compensation and litigation costs.

 

2.                  The brief facts of the complaint is that the complainant is a bonafide

domestic consumer being consumer no. A 020452 of total connected load 0.50 KW is consuming energy for his domestic purpose and the same is recording through a meter bearing no. 781358928. The complainant has paid her energy bill time to time so received and subsequently made an oral followed by a written complain to the o.p.; that the electric bill is excessive showing the meter is stop / defective in spite of the facts that the installed meter was running in order which she had noticed to the o.p. vide her letter dated 19-12-2011, 23-03-2012, 04-06-2012. All the attempts on the part of the complainant for raising correct unit consumption of energy consumed by her went unheeded. Hence the complaint. 

 

3.                  In spite of proper service of notice duly received on 19-09-2012 the o.p. did

not turn up. So the case was heard ex parte.

 

4.         Upon pleadings of both parties two points arose for determination :

 

i)          Is there any deficiency in service on the part of the O.P.  ?

ii)                  Whether the complainant is  entitled to get any relief as prayed for ? 

 

DECISION  WITH   REASONS      :

 

5.         Both the points are  taken up together for consideration. Perused the enclosures issued by Station Manager, Ajodhya CCC, Ayodhya, WBSEDCL, including yellow card, energy bill for the period March'12 to May'12, June'12 to Aug'12 and Sep'12 to Nov'12 sent to the complainant  and other photo copies of the relevant documents. In view of unchallenged enclosures we are of the view that the prayer of the complainant shall be allowed. 

 

      Points under consideration are accordingly decided.

 

      Hence,

                                    O     R     D      E      R      E        D

 

           

      That the C. C. Case No. 115 of 2012 ( HDF 115  of 2012 )  be  allowed    against  the O.P.  as ex parte.   

 

      The O.P., WBSEDCL Authority be directed to raise the revised energy bill through the computer regenerative system for the period March,2012 to November, 2012 within 30 days from this order taking into consideration the actual reading arrested by installing a challenge meter side by side  to the existing meter and adjust the bill according to the present consumption.  

     

      The o.p. is hereby directed to pay a compensation of Rs. 2,000/- and litigation costs of Rs. 1,000/- to the complainant within one month from the date of this order in default the entire amount of Rs. 3,000/- shall carry an interest @ 12% p.a. till realization.

 

            The complainant is at liberty to put the decree into execution after expiry of the appeal period.

       

      Supply the copies of the order to the parties, as per rule.
