             Neither the petitioner nor his representative appears in the Forum on repeated calls. It is also seen from the record that the petitioner has been absent in the Forum on last two occasions i.e. on 26.6.2008 and 0n 01.07.2008.
 
          In view of above there is no impediment to dismiss the case for default.
 
          Proper fees have been paid.
 
Hence,                                              ordered,
that Malda D.F. Case No.38/2008 is dismissed for default.
