Judgment/Final Order

 

On 27.12.2018 none was present on behalf of the legal heirs of the deceased Complainant. The said date was fixed for taking steps by the legal heirs of the Complainant, since deceased. The record speaks that since 13.06.2017 the Complainant remained absent on consecutive dates. On 09.11.2017 it was intimated that during pendency of   this complaint the Complainant has expired. So the legal heirs were directed to take appropriate step in accordance with law. Date was given on 13.12.2017. On the said date no step was taken, so in the interest of Natural Justice further date was given on 06.03.2018, but to no effect. Again on 29.06.2018 was fixed for taking step, no fruitful result yielded and lastly on 27.12.2018 was fixed for taking step by the legal heir/s of the deceased Complainant. But as on the said date no step was taken, hence we were no inclined to provide further date. Hence the complaint is abetted.

Hence it is ordered that the Consumer Complaint being no-163/2016 is hereby abetted due to death of the Complainant and non-taking of any step by the legal heir/s of the deceased.

 

Let plain copy of this order be given to the parties free of cost as per the provision of the CPR, 2005.
