FINAL ORDER

 

Instant complaint has been filed by the complainant u/s 12 of C. P. act, 1986 for electric connection in his agricultural land and Rs.50, 000/- as compensation for harassment and mental agony from the OP.

The complainant’s case, in brief, is that the complainant applied for electric connection before the OP for his submersible pump and afterward on the basis of quotation issued by the OP, he deposited the quotation money on 17.11.2014 to the OP. According to the complainant, he purchased a motor pump and made writing for connection also. But the OP did not pay any heed to that matter. Without giving eclectic connection, the Opposite Party sent two boils to the complainant, one is for the month of February to April, 2016 and another is for the month of May,2016 with the amount ofrs.1430/- and Rs.200/- . The complainant paid those bills,  without consuming any electricity, as because, the OP stated that it will be adjusted in future and within a fortnight from the date of 31 May, 2016 the electric connection would be effected, but till today no connection has been effected. So, the complainant suffered a lot and has come to this Forum for proper redress against the deficiency in service on the part of the Opposite Party.

On the other hand the OP appeared in this case by filing written version, where he denied all the material facts. The OP stated that he effected the electric connection 26.12.2014 to the complainant’s place vide meter No. L3830030 and the Consumer I.D. No. 30118658. The OP prepared and sent the bills on the basis of electricity consumption and the complainant paid those bills. The Op also stated that on 16.06.2016 the complainant lodged a General Diary at Jalangi Police Station and informed the OP that his pump set and electric meter were forcefully snatched. So, there is no deficiency in service on the part of the OP.

The only point for consideration is whether there is any deficiency in service on the side of the OP or not and or whether the complainant is entitled to get any relief or not.

                                             Decision with reasons.

It is pertinent to mention that the complainant has submitted some documents in support of his case.

Perused the record, we observed that the complainant deposited security money along with service connection charges on 17.11.2014 as well as paid bills for the month of February to April, 2016 and May, 2016 consequently as on 11.02.2016 and 31.5.2016 which all are admitted facts by both the parties.

But the complainant stated that the OP did not effect the connection and without consumed electricity he paid the bills, where as the OP demanded that he effected the connection on 26.12.2014 which is evident from the copy of yellow card, submitted by the complainant himself in this record.

Submitted money receipts also evidence that the complainant paid the bills, prepared by the OP on the basis of electric consumption. So, without consuming electricity paid bill amount by the complainant is not justified.

In addition , the OP stated in the written version that the complainant lodged a General Diary to the Jalangi Police Station as well as informed the OP that his meter and the pump set were snatched away, which incident proved that there was meter and pump was on running condition. But this incident also proved that the OP is not responsible for that disconnection due to snatching of meter or pump set. So, the OP has no deficiency in service in this case. Rather the complainant may assail for snatching the meter and pump set before appropriate Forum.

                                                        Order

Hence, it is ordered that the case 104/2016 be and allowed in part on contest subject to direction to the OP for reconnecting the Power Connection of the complainant within 30 days from the date of receiving the order and

Prepare bill as per consumption.

The OP is at liberty to collect the previous dues,  if any.

No other reliefs are allowed.

Let a plain copy of this order be made available and be supplied free of cost, to each of the parties on contest in person, Ld. Advocate/Agent on record, by hand under proper acknowledgment / be sent forthwith under ordinary post  to the concerned parties as per rules, for information and necessary action.
