FINAL ORDER

Sri Samaresh Kumar Mitra, Presiding Member.

            This complaint has been filed by the complainant’s u/s 12 of C. P. Act, 1986 praying for an order directing the OPs to pay Rs. 50,000/- as damages and interest on the said amount.

            From the case record it appears that since 25.10.16 the complainants were found to be absent. Several opportunities were given to the complainants to proceed with the case but they failed. Lastly on 20.03.17 the complainants were show caused as to why the complaint shall not be dismissed for non-prosecution and 20.3.17 was fixed for submitting such show cause.

On 20.3.17 the complainants were found to be absent. The OPs filed written version.

From the case record, we are of the opinion that the complainants are not interested to proceed with this case. They are dragging the case day by day by misusing the valuable time of the Forum. In our opinion the case should be dismissed for non-prosecution.

Hence,

                                             Ordered

that the Consumer Complaint No. 33/2015 be and the same is hereby dismissed for non-prosecution.

There will be no order as to cost.

Let a plain copy of this order be made available and be supplied free of cost, to each of the parties on contest in person, Ld. Advocate/Agent on record, by hand under proper acknowledgment / be sent forthwith under ordinary post  to the concerned parties as per rules, for information and necessary action.
