The complainant files lawyer’s hazira. Today is fixed for ex-parte hearing. The Op files W/o alongwith an application for vacating the order of ex-parte hearing on the ground that due to some unavoidable circumstances in the family of Ld. Advocate, necessary step could not be taken in this case and as such the case has been fixed for ex-parte hearing. Copy served. Hd. both sides. Ld. Lawyer for the Op submits that under some circumstances beyond control in the family of Ld. Lawyer for the Op, no step could be taken on the last date for which the case has fixed for ex parte hearing. He prays for vacating the order of ex-parte hearing and relieving the Op from making any payment of cost as the Op did not have any negligence. Although, the Ld. Lawyer for the complainant endorsed objection of the petition but during hearing the Ld. Lawyer for the complainant submits that in view of the ground as mentioned in the application and submitted by the Ld. Lawyer for the Op. he does not pray for any cost.
Upon such circumstances, let the order of ex-parte hearing be vacated and the w/o filed by the Op today be accepted. At the stage, Ld. Lawyers for both the parties submit that in view of the petition of compliant and the W/o filed today by the Op. the case may be disposed of today. Ld. Lawyers for both the parties came to the consensus that the case may be disposed of with the direction to the Op to restore the electric connection of the complainant and thereafter the Op. shall install a check meter and after monitoring the reading of the said check mater for two

months, fresh bill may be issued in view of the reading of the check meter and the previous bill may be corrected if any discrepancy is found in the reading of the old meter with reference to the reading of the check mater to be installed.
I think, that the proposal as made by the Ld. Lawyers for both the parties reasonable and modest. Hence
Order is passed accordingly on the basis of the proposal made by the Ld. Lawyers for both the parties as aforesaid. The Op shall comply with the order and restore the service connection of the complainant and install the check meter as early as possible preferably within two weeks from this date. Thereafter, the Op shall comply with the other direction which is given after accepting the proposal of the Ld. Lawyers for both the parties as aforesaid. It is made clear that if it is found that there is no discrepancy in the previous bill and with reference to the reading of the check meter, the amount of previous bill has to be paid by the complainant within 15 days from the date of receipt of intimation in the regard from the Op.
Accordingly, thus this case is disposed of.
Let copy of this order be supplied to the parties free of cost.
