            The case is taken up for order.

The  complainant files this case for sporadic and excessive billing of electricity against the o.ps., Station Manager,  West Bengal State Electricity Distribution Co. Ltd. , Bagnan, Howrah, and Chairman, W.B.S.E.D.C.L., Bidyut Bhawan, Salt Lake, Kolkata. The complainant contended that the bills for the month of April,2010 to June,2010 amounting to Rs. 2,829/- and October,2010 to December,2010 amounting to Rs. 7,630/- are excessive and this upward swing of drawing of the bill is baseless, perplexing and vexatious.

The o.ps. contested the case by filing written version.

In fact we are unable to pass any order over relief as prayed in the petition of complaint. This is because the case itself is not maintainable before this Forum in view of the provision contained in 3.5.1(a) of the West Bengal Regulatory Commission which provides for the reference of any dispute regarding bills to the Grievance Redressal Officer and thereafter for appeal to the Ombudsman against the order of the Grievance Redressal Officer.

In view of such expressed provision in the statute itself ( West Bengal Electricity Regulatory Commission ) we are of the view that the case is not maintainable before this Forum.

Hence,

O  R  D  E  R  E  D

            That the complaint case is dismissed with liberty to the complainant to prefer the appropriate Forum.

            Supply the copy of this order to the parties, as per rule.
