FINAL ORDER / JUDGEMENT

No step is taken by the Complainant who is found absent on repeated call.

No step is taken by the O.P. No.1.

O.P. No.2 is present by filing hazira.

The case is fixed for production of the original Tenancy Agreement dated: 24/05/2024.

It appears from the record that by an interim order dated: 14/08/2024 the Commission was pleased to direct O.P. No.1 to give separate electric connection to the Complainant in her name as tenant on the basis of Tenancy Agreement dated: 24/05/2024. Thereafter on the prayer of O.P. No.2 being the Landlord the Commission by order dated: 22/08/2024 stayed the operation of the said interim order as the Tenancy Agreement in question is alleged to be forged and fabricated. The Complainant has failed to produce the original Tenancy Agreement dated: 24/05/2024 and in such facts and circumstances of the case O.P. No.2 being an Advocate of the Local Bar Association has made a verbal submission before the Commission for passing necessary order to restrain the Complainant to use the said original Tenancy Agreement anywhere otherwise his interest as Landlord will be prejudiced.

Apprehending criminal implication in the matter the Complainant might have tactfully avoided the production of the original Tenancy Agreement which is alleged to be in her custody. But without production of original document the Commission cannot proceed further with the case.

It is reported by O.P. No.2 that O.P. No.1 has complied with the order of the Commission dated: 22/08/2024 by disconnecting the electric connection in the name of the Complainant. An adverse inference is drawn by the Commission for withholding the production of the original Tenancy Agreement dated: 24/05/2024 and the Commission hopes that the Complainant will not dare to use the said document claiming tenancy right in future.

With this observation the case is disposed of for non-prosecution.         

Both parties be supplied copy of this Order free of cost.
