FINAL ORDER / JUDGEMENT

Both parties file hazira through Advocate.

The case is fixed for argument.

After hearing argument from both sides the Commission proceeds to dispose of the case as hereunder: -

The Complainant’s case is that he has applied for electric connection to his residential house and as per Quotation dated: 02/04/2023 he has paid requisite fees on 02/05/2023 but he has not yet been provided electric connection for the reason best known to the O.P. Hence this case.

O.P. contested the case by filing a written version contending that they are ready and willing to give the electric connection as prayed for but one Dhirendra Nath Dey and Goutam Pal being the neighbours have submitted objection separately on 22/05/2023 to the electric connection of the Complainant. Without disposal of the objection they are unable to install electric connection as prayed for.

                                                                                  -: Decision with reasons: -

Having regard to the facts of the case, submission, contention and documents on both sides the Commission finds that the O.P. has not exercised their power and authority for hearing of the objection and find out the proper Right of Way (ROW) for the new electric connection of the Complainant. Nature of objections which are on record do not inspire the Commission to hold that the objections are valid and genuine. It is also not clear from the objections whether transmission line of electric supply of the Complainant will interfere or create any land dispute between the Complainant and the Objectors. Mere filing objections by the neighbours cannot stand on the way of the consumer of being deprived of electric connection which is an essential service for human living. The O.P. enjoins the duty to give an opportunity to both the Complainant and the Objectors of being heard as to the nature of objections and take decision accordingly after holding necessary enquiry.

Accordingly it is ordered…….

that the case be and the same is disposed of on contest by directing the O.P. to give an opportunity of hearing to the Complainant and the above mentioned Objectors so as to seek permission for Right of Way (ROW) for transmission of electric supply to the residential house of the Complainant without interference into the right title interest of the Objectors and to dispose of the application of the Complainant for electric connection after holding necessary enquiry to that effect within a month from this date otherwise the Complainant is at liberty to seek redressal of his grievance before the appropriate forum.                                                                                                                                            

Both parties be supplied copy of this order free of cost.
