Both parties file hazira through Advocate.

The case is fixed for argument.

After hearing argument from both sides the Commission proceeds to dispose of the case as hereunder: -

The Complainant’s case is that he applied for new electric connection to his Stationery shop and duly deposited service connection charge for Rs.400/- and Security deposit of Rs.871/- on 19/04/2022 under proper receipt but the O.P. failed to give the connection as applied for in spite of reminder and persuasion. The Complainant has therefore approached this Commission for appropriate relief.

The O.P. contested the case by filing a written version stating therein that they are ready and willing to give the connection to the Complainant but due to resistance offered by his paternal uncle they are not able to discharge their duty. The O.P. has therefore prayed for Police protection for giving the service connection to the Stationery shop of the Complainant.

                    -: Decision with reasons: -

Having regard to the facts of the case, contention and submission and documents on both sides the Commission finds that the Complainant is awaiting electric connection to his Stationery shop but his Paternal uncle Santosh Garai is creating obstruction to the same out of animosity.

We find no written objection of said Santosh Garai on record either produced by the Complainant or by the side of O.P. It is only an apprehension of the Complainant and the O.P. regarding the resistance to be offered by said Santosh Garai.

In absence of any written objection from any third party the O.P. is at liberty to discharge their duty by giving electric connection to the Complainant as applied for and if any resistance is offered by such third party or any stranger the O.P. may seek for Police protection under the law in carrying out their duty but the O.P. without exhausting the procedure has denied the electric connection to the Complainant during this long period.

Be that as it may the O.P. should immediately give electric connection to the Stationery shop of the Complainant with Police protection from the concerned Police Station in case of any resistance offered by said Santosh Garai.

The case therefore succeeds.

Hence it is ordered……..

That the case be and the same is allowed on contest but without cost.

The O.P. is directed to give electric connection to the Stationery shop of the Complainant within a month from this date  after removing obstruction / resistance if any offered by said Santosh Garai  Police protection from the concerned P.S. in default O.P. will incur liability in accordance with law.

The concerned Police is directed to provide police protection to the O.P. in enforcing the Order of this Commission.

Both parties be supplied copy of this Judgement free of cost.
