The case of the complainant, in brief, is as follows

The case of the complainant, in short, is that the complainant applied to the Op No.1 for giving domestic electric connection at his house at holding No.834 under the Midnapore Municipality and after inquiry the OP No.1 on 1/1/12 gave quotation.  Accordingly, the Op No.1on receipt of the quotation amount on 3/1/12 gave the complainant his consumer ID No.201197921.  Therefore, the complainant became consumer under the Op Nos.1&2 and after doing the electrical wiring work at the house, submitted test report to the Op No.1.  Thereafter, the Op No.1 tried for giving electric connection to the consumer but due to obstruction by some local people, the connection could not be given.  The complainant informed the incident to the local police then they asked that they would render police help only when it is required by the office of the op No.1.  The complainant informed it to the Op No.1 but the Op No.1 did not take any step.  So, the complainant contended that there was deficiency in service on the part of the Op No.1 and prayed for necessary direction upon the Op No.1 for giving electrical connection.

The Ops contested the case by filing a W/O wherein, everything has been admitted.  The Ops admitted the filing of application by the complainant, sending quotation by the OP No.1 and deposit of the quotation amount by the complainant.  The Ops contended that the contractor engaged by the Ops could not execute the work order relating to supply of electricity connection to

the house of the complainant because of resistance by some local people.   Therefore, the OP contested that there was no deficiency in service.

     It is now for our consideration as to whether the complainant is entitled to get the relief as prayed for.

Decisions with reasons

     In this case, it is an admitted position that the complainant filed an application for supply of domestic electricity connection at his house at holding No.834 under the Midnapore municipality, that the Op No. 1 issued quotation for such connection and that, the complainant duly deposited the amount as per quotation.  It also appears to an admitted position that the Op No.1 tried for giving electric connection to the house of the complainant but due to resistance by some local people the connection could not be given.  During hearing, the Ld. Lawyer for the Ops fairly submitted that the Op No.1 was always willing and still he is willing to give electric connection to the complainant.  He contended that the connection work could not be finished as some local people put up resistance and without the police help the connection could not be given.  He further submitted that the complainant was asked to furnish alternative way/leave but he failed to do so.  In this regard Ld. Lawyer for the complainant submitted that it is not possible on the part of the complainant to furnish alternative way/leave.

      Under such circumstances, we find that, in fact, there is no dispute in this case save and except executing the order of extending electric connection to the house of the complainant.  Such being the position, the Op No.1 may be asked to give electric connection to the complainant and in doing so, if any resistance is put by any person (s), in that event the Op No.1 shall carry out the work with the help of the local police.

Hence, it is, ordered:-

That the case succeed on contest. The Ops are hereby directed to give domestic electric connection to the house of the complainant at holding No.834 under the Medinipur Municipality within 30 days from this date.  It is made clear that if any kind of resistance is put by any person(s), in that event the Ops shall carry out the work of giving electric connection to the house of the complainant with the help of the police.  It is further made clear that the local police authority shall extend necessary help to the Ops for the purpose of carrying out this order.

  Considering the facts and circumstances of the case, we do not propose to pass any order regarding compensation or any cost.
