Today is the date fixed for admission hearing of the instant case. The ld. Advocate for the complainant represents his client(complainant) by filing hazira on behalf of the complainant.
Heard the ld. Advocate for the complainant over the admission hearing of this case. Perused and considered the instant petition of complaint and photocopies of documents filed on record.
It appears (as per petition of complaint) that the complainant deposited service connection fee and quotation money in favour of OP on 17.10.2008 and 15.06.2010 respectively and agreement was executed on 12.07.2010 and that the complainant submitted SEB no. 5 on 22.05.2009 as per letter dtd. 24.02.2009 of OP no.1. According to the complainant, he again requested the OP no.1 on 10.12.2013 and 26.06.2014 verbally for the said electric connection.
The contention made in the petition of complaint suggests that the cause of action of this case has arisen since 17.10.2008 when the complainant deposited service connection fees of Rs.240/- in favour of the OP no.1 but not on 26.06.2014 as mentioned in the petition. it is found that as per period of limitation (2 years) u/s 24A of C.P. Act to file this case from the above dated cause of action has already been expired long ago.
The said cause of action dtd. 17.10.2008 cannot be extended even after verbal request on 10.12.2013 and on 26.06.2014 as alleged to have been made by the complainant to OP no.1.
Apart from that no reasons for condonation of inordinate delay, for about 6 years, has been made by the complainant by any application for condonation of such delay.
Therefore, we feel that the instant petition of complaint being barred by limitation is liable to be dismissed.
Hence, it is,
Ordered
that the instant petition of complaint figured as CC case no. 49/2014 be and the same is dismissed being barred by limitation as provided u/s 24A of the Consumer Protection Act.
